UDA says High Court ruling on ANC dissolution ‘overtaken by events’

NAIROBI, Kenya — Jan 23, 2026—The United Democratic Alliance (UDA) has dismissed a recent High Court ruling declaring the voluntary dissolution of the Amani National Congress (ANC) unlawful, calling the judgment “overtaken by events.”

In a statement, UDA Deputy Party Leader and Lamu Governor Issa Timamy said all ANC assets were legally transferred, and no formal merger exists between the two parties.

“What was done was a voluntary dissolution of the ANC party by its members, and therefore the matter of the ANC party having merged with UDA is, with respect, not factual,” Timamy said.

The High Court ruled on Thursday that ANC’s dissolution violated the Constitution and the Political Parties Act, declaring the party remains fully registered and legally recognised.

The court invalidated a Gazette Notice issued by the Registrar of Political Parties formalising the dissolution and ordered the Registrar to update the official register accordingly.

The judgment also restrained any transfer or interference with ANC’s assets effective from February 6, 2025, while granting a 45-day stay of execution to allow for potential appeals.

Legal experts say the ruling could have significant political implications ahead of the 2027 General Election, particularly regarding party mergers, defections, and realignments
